THIS AGREEMENT INCLUDES A PROVISION FOR ARBITRATION. ADDITIONALLY, THESE TERMS PROHIBIT CLASS AND REPRESENTATIVE ACTIONS AND NON-INDIVIDUALIZED RELIEF FOR ALL MATTERS, WHETHER PURSUED IN COURT OR THROUGH ARBITRATION. THEY ALSO CONTAIN VARIOUS LIMITATIONS AND EXCLUSIONS, ALONG WITH A CLAUSE THAT DICTATES THE JURISDICTION, VENUE, AND GOVERNING LAW FOR DISPUTES (EXCEPT WHERE PROHIBITED). FURTHERMORE, YOU ARE OBLIGATED TO ADHERE TO ALL APPLICABLE LAWS AND REGULATIONS.
1. Definitions
This section will now be expanded based on the definitions from the provided Terms of Service document:
a.
“Renter” ("You"): The individual or entity who reserves, rents, or uses a vehicle provided by Veygo, through our Services.
b.
“Authorized Driver”: The Renter and any additional driver(s) authorized to operate the rented vehicle under this Agreement. The Renter's spouse or domestic partner (same or opposite sex) may also be included as an Authorized Driver if they meet all eligibility requirements, including providing a valid driver's license.
c.
“Vehicle”: The car or other vehicle rented through Veygo under this Agreement, either owned by Veygo or another partner as specified in the rental agreement.
d.
“Rental Period”: The period during which the Vehicle is rented, as agreed in the Rental Agreement and confirmed through the Services.
e.
“Services”: All Veygo services accessible through our website (
www.rentveygo.com and www.veygo.rent), blog, mobile applications, and any other platforms providing car rental services. This includes rental management, vehicle reservations, and other related services.
f.
“Rental Agreement”: The specific agreement between Veygo and the Renter for each rental, covering details such as vehicle type, rental duration, fees, insurance, and conditions.
g.
“Fees”: Any and all charges payable by the Renter, including rental fees, taxes, insurance fees, late fees, cleaning fees, damage charges, and other applicable fees as outlined during the reservation process.
h.
“Protection Plan”: The insurance or protection plans available through Veygo’s services, which provide coverage for liability, collision damage, or theft as specified in the plan chosen by the Renter.
i.
“Website”: The official Veygo website (
www.rentveygo.com and www.veygo.rent) where reservations, rentals, and other transactions occur.
j.
“Trip”: The full experience of booking and using a vehicle through Veygo, from the moment of reservation until the vehicle is returned.
k.
“User”: Anyone interacting with Veygo services, including Renters, partners, or anyone accessing the Veygo website or mobile applications.
l.
“Prohibited Activities”: Activities outlined in these terms that are not allowed while using a rented vehicle or any of Veygo’s services. These include, but are not limited to, illegal activities, tampering with vehicle equipment, and engaging in commercial use without written consent from Veygo.
2. Eligibility, Registration, and Verification
Eligibility
a.
Age Requirement: Veygo’s services are designed for Renters who are at least 18 years of age. All drivers must possess a valid driver’s license issued in the United States. For some vehicle categories or insurance options, higher age limits may apply (e.g., 21 years for certain higher-value vehicles).
b.
Student Status: Veygo caters specifically to students or staff of Purdue University or other eligible institutions. Proof of current enrollment (such as a student ID) must be provided at the time of reservation.
c.
Driver’s License: All Renters and any Authorized Drivers must present a valid, non-expired driver’s license, which is in good standing and matches the information provided during registration and booking.
d.
Credit or Debit Card: A valid credit or debit card in the Renter’s name is required for all reservations. Veygo reserves the right to perform pre-authorization checks to verify funds before confirming a booking.
e.
Legal Compliance: Renters must comply with all applicable local, state, and federal laws during the rental period. Violations may result in the termination of the rental and forfeiture of fees.
Verification
a.
Identity Verification: Veygo reserves the right to verify the identity of all users at any time. This may include verifying your driver’s license, vehicle insurance coverage (if applicable), and any other details provided during the registration or booking process. Veygo may use third-party services to conduct these verifications.
b.
Driving History and Background Checks: In some cases, Veygo may perform background checks to assess your driving history, including driving violations or incidents. Veygo reserves the right to deny or revoke access to its services based on the results of these checks.
c.
Vehicle Verification: For vehicles owned by partners, Veygo may conduct vehicle verification to ensure compliance with safety and operational standards. The Renter acknowledges that Veygo does not guarantee the condition, safety, or roadworthiness of any vehicle beyond what is outlined in our policies.
d.
Right to Deny Service: Veygo reserves the right to deny or revoke access to its services at any time, including rejecting a booking request or registration, based on eligibility criteria or the results of verification checks.
Modifications to Eligibility and Registration
Veygo retains the right to modify eligibility criteria, verification procedures, and registration requirements at any time. Any changes to these conditions will be communicated to users via email or updated in these Terms.
Collection and Use of Phone Numbers
By agreeing to these Terms, you acknowledge and consent to the collection and storage of your phone number by HQ Rental Software on behalf of ARC Rentals LLC (doing business as "Veygo") for operational purposes. Veygo shall use your phone number solely to communicate with you regarding your reservation, including confirmations, reminders, updates, and other reservation-related notifications. Veygo affirms that it will not sell, rent, disclose, or otherwise share your phone number with any third parties for marketing or other purposes unrelated to your reservation, except as required by law or as necessary to fulfill its contractual obligations to you.
3. Fees, Taxes, and Payment
Fees
a.
Rental Fees: The fees associated with renting a vehicle from Veygo, including the base rental rate, taxes, insurance fees, and any additional charges, are clearly displayed during the booking process. The total rental cost must be paid at the time of reservation.
b.
Additional Fees: Renters may incur additional charges during their rental period, which can include (but are not limited to):

Late Return Fees: A fee of $20 per hour, prorated for each minute, applies for late returns beyond the agreed-upon return time. This fee is capped at a maximum of the daily rental rate for each 24-hour period the vehicle is late.

Cleaning Fees: A cleaning fee of up to $250 will be charged if the vehicle is returned in a condition requiring more than standard cleaning, including excessive dirt, odor, pet hair, or spills.

Fuel Fees: Renters are required to return the vehicle with the same amount of fuel it had at the time of pickup. If the vehicle is returned with less fuel, a refueling fee of $6 to $8 per gallon, plus a $10 convenience fee, will be charged based on the type of vehicle.

Mileage Overages: Rentals come with a daily mileage limit of 250 miles. Additional mileage will be charged at $0.45 per mile for economy vehicles and $0.65 per mile for luxury or electric vehicles.

Damage Fees: Any damage to the vehicle during the rental period is the financial responsibility of the Renter, and the cost of repairs will be determined by an authorized inspection. See section on Liability and Insurance for further details.

Administrative Fees: In case of any damage, traffic violation, toll charges, or other incidents requiring administrative work, an administrative fee of $50 may be charged in addition to the actual cost incurred.
c.
Security Deposits: For certain vehicles or high-value rentals, Veygo may require a security deposit at the time of reservation. The deposit will be refunded at the end of the rental period, provided no additional charges are incurred, such as damage fees or late return penalties.
Taxes
a.
Applicable Taxes: Taxes applicable to your rental, including local and state sales tax, vehicle license fees, or other relevant taxes, will be included in the total rental price and will be itemized during the booking process. The exact amount of tax will depend on the location where the vehicle is rented and may vary by jurisdiction.
b.
Tax Collection and Remittance: In certain jurisdictions, Veygo may be required to collect and remit taxes on behalf of the Renter or the partner providing the vehicle. Veygo will itemize these taxes separately, and they will appear on your rental invoice. By using our services, you acknowledge that you are responsible for all applicable taxes.
Payment
a.
Accepted Payment Methods: Veygo accepts payment by major credit and debit cards, including Visa, MasterCard, and American Express. The payment card used for reservation must match the name of the Renter.
b.
Payment Timing: Full payment for the rental, including any insurance and protection plans, is required at the time of booking. For longer-term rentals, Veygo may authorize a hold on your card for additional future charges, such as late fees, damages, or fuel charges.
c.
Authorization for Charges: By providing Veygo with your payment details, you authorize us and our payment processors to store your payment credentials and automatically charge you for all fees incurred under this Agreement, including any additional fees or penalties that arise during your rental period.
d.
Chargebacks and Delinquent Payments: If your payment method is declined, or a chargeback is issued, Veygo may immediately suspend or terminate your account and reservation. Veygo reserves the right to pursue all legal avenues, including engaging third-party collection agencies, to recover outstanding balances. Any fees related to collections, including legal and administrative fees, will be added to the amount owed.
Refunds and Cancellations
a.
Cancellation Refunds: Cancellations made more than 24 hours prior to the rental period will receive a 70% refund. Cancellations made within 24 hours of the rental start time are non-refundable.
b.
Refunds for Unused Rental Days: No refunds will be given for early returns or unused rental days unless agreed upon under specific conditions (e.g., mechanical failure not due to Renter’s fault).
4. Vehicle Pickup and Return
Pickup Requirements
a.
Driver’s License and Identification: At the time of vehicle pickup, the Renter must present a valid, non-expired driver’s license and the credit or debit card used for the reservation. The name on both must match the information provided at the time of booking. Veygo reserves the right to deny the rental if these documents are not presented or if they do not meet Veygo’s eligibility criteria.
b.
Reservation Confirmation: The Renter must arrive at the designated pickup location at the agreed time, as stated in the reservation confirmation email. If the Renter is more than 30 minutes late without prior notification, the reservation may be canceled, and the Renter will forfeit the full reservation fee.
c.
Vehicle Inspection: Before taking possession of the vehicle, the Renter must conduct a visual inspection of the vehicle’s exterior and interior. Any pre-existing damage should be documented and reported to Veygo immediately. Failure to report any damage prior to starting the rental may result in the Renter being held liable for that damage.
d.
Vehicle Condition: Veygo ensures that vehicles are clean, properly maintained, and roadworthy at the time of pickup. The Renter must verify that the vehicle is in satisfactory condition before leaving the pickup location.
Return Requirements
a.
Return Time: The vehicle must be returned to the designated return location at the agreed time as stated in the Rental Agreement. Late returns beyond the agreed time are subject to the late return fee of $20 per hour, as previously outlined in the Fees section.
b.
Return Condition: The vehicle must be returned in the same condition as it was at the start of the rental, excluding normal wear and tear. The Renter is responsible for ensuring the vehicle is clean, refueled to the same level as at pickup, and free from any damage. Failure to return the vehicle in the required condition may result in cleaning fees, repair costs, and administrative fees.
c.
Final Inspection: Upon return, the Renter must conduct a final inspection of the vehicle together with a Veygo representative (if available). Any damage discovered after the return will be the responsibility of the Renter, unless it was written on the damage record.
d.
Fuel and Mileage: The vehicle must be returned with the same fuel level as at the start of the rental. If the vehicle is returned with less fuel, refueling fees will apply as detailed in the Fees section. Additionally, the Renter must not exceed the agreed mileage limit. Any excess mileage will incur the applicable fees.
Early Returns and Extensions
a.
Early Return: Renters may return the vehicle before the scheduled end of the rental period; however, no refunds or credits will be issued for unused rental days unless there is an agreed-upon reason (e.g., mechanical issues not caused by the Renter).
b.
Rental Extensions: Renters may request to extend the rental period by contacting Veygo before the scheduled return time. Extensions are subject to vehicle availability and additional charges. If the extension is approved, the additional charges must be paid at the time of the request.
No-Show Policy
a.
No-Show Fees: If the Renter fails to appear for pickup within 30 minutes of the scheduled time and does not contact Veygo to adjust the time or cancel the reservation, the booking will be considered a no-show. In such cases, the full reservation fee will be forfeited, and the vehicle will be made available to other customers.
Abandonment of Vehicle
a.
Unauthorized Returns: If the vehicle is abandoned or returned to a location not agreed upon in the Rental Agreement, additional fees may apply. These fees may include towing, storage, and administrative costs incurred in recovering the vehicle.
Condition of Vehicle on Return
a.
Vehicle Inspection: Upon return, a Veygo representative will inspect the vehicle for any damage not previously noted at pickup. If no representative is present, Veygo reserves the right to inspect the vehicle within 24 hours of return. Renters are responsible for any damage identified during this inspection.
b.
Cleaning Requirements: The vehicle must be returned in a reasonably clean condition. If the vehicle is excessively dirty (e.g., food, trash, pet hair, odor), a cleaning fee will be applied, as outlined in the Fees section.
c.
Damage Liability: The Renter is responsible for any damage, theft, or loss that occurs during the rental period. All damages will be assessed, and the Renter will be charged for repair costs, as well as administrative fees related to processing the claim.
5. Use of the Vehicle
Permitted Use
a.
Personal Use: Vehicles rented through Veygo are intended for personal use only. Renters are prohibited from using the vehicle for commercial purposes, including but not limited to:Ride-sharing services (e.g., Uber, Lyft)Food or goods delivery (e.g., DoorDash, Instacart)Towing or transporting oversized loads.
b.
Authorized Drivers: Only the Renter and any additional drivers specifically listed in the Rental Agreement as “Authorized Drivers” are permitted to operate the vehicle. All drivers must meet Veygo’s eligibility criteria, including holding a valid driver’s license and being an active Purdue student or staff.
c.
Compliance with Laws: Renters and all Authorized Drivers must comply with all local, state, and federal laws while operating the vehicle. This includes adherence to speed limits, traffic signals, and any laws regarding driving under the influence of alcohol or drugs.
d.
Geographical Restrictions: The vehicle may only be operated within the geographical boundaries specified in the Rental Agreement, which generally limits use to the United States. If you plan to drive across country lines or into a prohibited area, you must seek written approval from Veygo prior to the rental period. Unauthorized use outside these boundaries may result in additional charges and penalties.
Prohibited Uses
Renters and Authorized Drivers must not use the vehicle in the following ways:
a.
Illegal Activities: The vehicle may not be used for any illegal activities, including but not limited to the transportation of illegal substances, contraband, or stolen property.
b.
Reckless Driving: Engaging in reckless driving or dangerous maneuvers, such as racing, stunt driving, or aggressive driving, is strictly prohibited. Any such use will result in the immediate termination of the rental agreement, and the Renter will be fully responsible for any resulting damages or legal penalties.
c.
Unauthorized Drivers: Allowing anyone other than Authorized Drivers to operate the vehicle is prohibited. If an unauthorized driver operates the vehicle, the Renter will be fully responsible for any damage, accidents, or violations incurred during that time.
d.
Towing and Off-Roading: The vehicle is not to be used for towing trailers, boats, or any other vehicles, nor may it be driven off-road unless explicitly allowed by Veygo in the Rental Agreement. Unauthorized off-roading or towing will void any protection plan or insurance coverage and result in additional fees.
e.
Tampering with Vehicle Equipment: Any tampering with the vehicle’s GPS, telematics systems, or other equipment is strictly forbidden. Veygo may install tracking devices for safety and insurance purposes. Disabling or interfering with these devices will result in penalties and may lead to termination of the rental.
f.
Overloading: The vehicle must not be overloaded with passengers or cargo beyond the manufacturer’s specifications. Overloading can lead to unsafe driving conditions and potential damage to the vehicle, for which the Renter will be liable.
g.
Improper Storage or Use: Leaving the vehicle unattended with the keys inside, running, or unlocked is prohibited. This includes parking in unsafe or illegal areas, such as no-parking zones, where the vehicle may be towed or damaged.
h.
Impaired Driving: Driving under the influence of drugs, alcohol, or any substances that impair the ability to operate the vehicle safely is prohibited. Any violation of this rule will result in immediate termination of the rental agreement and full liability for any damages or legal consequences.
Responsibilities of the Renter
a.
Vehicle Care: The Renter is responsible for exercising reasonable care during the use of the vehicle. This includes adhering to regular driving practices, avoiding any damage, and ensuring that the vehicle remains in proper working condition during the rental period.
b.
Emergency Situations: In the event of an accident, mechanical issue, or emergency, the Renter must immediately notify Veygo and follow all instructions provided. The Renter must also follow all legal requirements for reporting accidents or incidents to the authorities and insurance companies.
c.
Child Safety: Renters are responsible for ensuring that all passengers, especially children, comply with local seat belt laws and child safety regulations. Child safety seats must be properly installed if required by law.
d.
Parking and Tolls: The Renter is responsible for any parking tickets, tolls, or traffic violations incurred during the rental period. Veygo may charge the Renter for any unpaid violations, plus administrative fees, after the rental has concluded.
e.
Telematics and Vehicle Data: Vehicles rented through Veygo may have on-board telematics devices that monitor vehicle performance, location, and driving behavior. By renting a vehicle from Veygo, you consent to the use of these devices and agree not to tamper with or disable them. Veygo reserves the right to use data collected from these devices to ensure compliance with the Rental Agreement and to assist in resolving any disputes.
Consequences of Prohibited Use
a.
Termination of Rental: Veygo reserves the right to terminate the rental agreement immediately if it suspects that the vehicle is being used in violation of any laws, these terms, or in any way that endangers the safety of the vehicle, driver, or others.
b.
Financial Liability: Renters who engage in prohibited uses will be held fully responsible for all damages, legal fees, fines, and other costs incurred as a result of their actions. This includes voiding any insurance or protection plan coverage.
c.
Legal Action: Veygo reserves the right to pursue legal action against any Renter who uses the vehicle in an unlawful manner or violates the terms of this agreement. Legal action may include reporting violations to law enforcement or filing civil claims for damages.
6. Insurance and Liability
Insurance Coverage Options
a.
Veygo’s Protection Plans: Veygo offers protection plans for Renters to cover liability and vehicle damage during the rental period. These protection plans are optional but highly recommended. When booking a vehicle, Renters can select from available protection plans that provide varying levels of coverage, including:
Liability Coverage: Covers third-party bodily injury and property damage in compliance with local laws.
Collision Damage Waiver (CDW): Protects against the cost of damages to the rented vehicle with a deductible that applies to each incident.
b.
Deductibles: If you purchase a Collision Damage Waiver (CDW) or comprehensive coverage, a deductible applies. The amount of the deductible depends on the protection plan chosen. In case of damage or theft, the Renter will be responsible for the deductible before insurance coverage applies.
c.
Declining Veygo’s Insurance: If the Renter chooses to decline Veygo’s insurance options, they must provide proof of personal insurance that meets or exceeds the minimum coverage required by local and state law. In the event of an accident, the Renter’s personal insurance will be primary, and Veygo’s coverage will not apply unless otherwise stipulated in the rental agreement.
Renter’s Financial Responsibility
a.
Responsibility for Damage: The Renter is financially responsible for all physical damage, theft, or loss to the rented vehicle during the rental period, regardless of fault, unless covered by a Veygo protection plan or personal insurance. The Renter is also responsible for any damages caused by an Authorized Driver or other party allowed to operate the vehicle.
b.
Exclusions to Coverage: Insurance coverage and protection plans may be voided in the following situations:Use of the vehicle for prohibited activities, such as illegal activities or commercial use without prior authorization.Tampering with or disabling the vehicle’s safety equipment or GPS tracking devices.Failing to comply with Veygo’s terms and conditions, including driving under the influence of drugs or alcohol.Unauthorized drivers operating the vehicle.
c.
Accident Reporting: In the event of an accident or damage to the vehicle, the Renter must immediately notify Veygo and provide a police report if applicable. Failure to report an accident promptly may result in the denial of insurance coverage. The Renter is also responsible for cooperating with Veygo, law enforcement, and insurance adjusters in resolving any claims.
Liability for Third-Party Claims
a.
Third-Party Injury or Property Damage: Renters are responsible for any third-party claims, including bodily injury or property damage, resulting from the operation of the vehicle during the rental period. If a third party makes a claim, and the Renter has not purchased liability coverage through Veygo, the Renter’s personal insurance will be required to cover any damages.
b.
Legal Proceedings: If a legal claim or lawsuit arises from the Renter’s use of the vehicle, Veygo will not be responsible for providing legal representation or covering legal costs unless explicitly stated in the protection plan. The Renter agrees to indemnify and hold Veygo harmless from any legal actions resulting from their use of the vehicle.
Telematics and Tracking Devices
a.
Vehicle Monitoring: Vehicles rented through Veygo may be equipped with GPS tracking devices or telematics systems that monitor vehicle location, speed, and other operational data. By renting a vehicle from Veygo, the Renter consents to the use of these devices. This data may be used to verify compliance with the rental agreement and in the event of an accident or violation.
b.
Data Use: The data collected by telematics devices may be used to assist in insurance claims, accident investigations, and verifying the use of the vehicle in compliance with these terms. Veygo reserves the right to provide this data to law enforcement or insurance providers as required.
Limits of Liability
a.
Veygo’s Liability: Veygo is not liable for any indirect, incidental, or consequential damages that result from the use or inability to use the rented vehicle. Veygo’s liability is limited to the fees paid for the rental, excluding damage, loss, or theft caused by the Renter or third parties.
b.
Renter’s Liability: The Renter agrees to indemnify and hold Veygo, its partners, employees, and affiliates harmless from any claims, lawsuits, or damages arising from the use of the vehicle, including legal fees, court costs, and any claims made by third parties.
Coverage for Personal Items
a.
Personal Belongings: Veygo is not responsible for the loss, theft, or damage of any personal belongings left in the vehicle during the rental period. The Renter is encouraged to remove all personal items from the vehicle at the end of the rental period.
7. Damage, Theft, and Loss
Responsibility for Damage
a.
Damage During Rental Period: The Renter is responsible for any and all damage to the vehicle that occurs during the rental period, regardless of fault, unless covered by a purchased protection plan. The protection plan
does not cover the following types of damage:
- Tire damage: Includes punctures, blowouts, or any other damage to the tires.

Windshield or glass damage: Any cracks, chips, or other damage to the windshield or vehicle windows.
-
Interior damage: Damage to the interior of the vehicle, including stains, spills, burns, or other harm to the upholstery, dashboard, or interior components.
b.
Reporting Damage: Any damage must be reported immediately to Veygo and documented via photos or videos. Failure to report damage before the vehicle is returned may result in the Renter being held liable for the full cost of repairs, even if the damage was caused by a third party or unknown circumstances.
c.
Cost of Repairs: The cost of repairs will be determined by an authorized service provider or based on Veygo’s assessment. The Renter will be responsible for covering the full repair cost for tire, windshield, and interior damage, regardless of whether a protection plan was purchased.
d.
Administrative Fees: In addition to the cost of repairs, Veygo may charge an administrative fee of up to $50 to cover the costs of managing the repair process, damage assessment, and communication.
Theft or Loss of Vehicle
a.
Responsibility for Theft: The Renter is responsible for the full replacement value of the vehicle in the event of theft or loss during the rental period, unless covered by a protection plan or insurance. This responsibility applies whether or not the vehicle was locked at the time of the theft.
b.
Reporting Theft: In the event the vehicle is stolen, the Renter must immediately report the theft to local law enforcement and notify Veygo. The Renter must provide Veygo with a copy of the police report and cooperate fully with any investigation. Failure to report a theft within 24 hours may result in the Renter being held fully liable for the vehicle’s replacement.
c.
Vehicle Recovery: If the vehicle is recovered after being reported stolen, Veygo will assess the condition of the vehicle and determine if any damage occurred during the theft. The Renter will be responsible for any damage or loss of value to the vehicle caused during the theft, unless a protection plan covers such incidents.
d.
Negligent Loss: If the Renter leaves the vehicle unlocked, with the keys inside, or in a manner that facilitates theft, the Renter will be fully responsible for the replacement cost of the vehicle, even if a protection plan was purchased.
Loss of Personal Items
a.
Personal Belongings: Veygo is not responsible for any personal belongings left in the vehicle during the rental period or after the vehicle is returned. The Renter assumes all risk for loss, theft, or damage to personal items left in the vehicle.
b.
Vehicle Recovery Fees: If the Renter abandons the vehicle, or it is impounded due to the Renter’s actions, the Renter will be responsible for any recovery fees, including towing, storage, and administrative fees incurred by Veygo.
Liability for Unreturned Vehicle
a.
Failure to Return: If the Renter fails to return the vehicle at the agreed-upon time and location, Veygo reserves the right to report the vehicle as stolen and pursue legal action, including the recovery of the vehicle at the Renter’s expense.
b.
Charges for Non-Return: In the event of a non-return, the Renter will be charged for each day the vehicle remains unreturned, at a rate equivalent to the daily rental rate, plus any applicable late fees. In addition, the Renter will be responsible for any legal fees, recovery costs, or administrative fees incurred in retrieving the vehicle.
Insurance and Protection Coverage Limitations
a.
Exclusions: Any damage, theft, or loss resulting from the Renter’s prohibited use of the vehicle, as outlined in the “Use of Vehicle” section, will not be covered by Veygo’s protection plans or insurance policies. This includes:
Using the vehicle for illegal activities
Allowing unauthorized drivers to operate the vehicle
Driving the vehicle off-road, towing, or exceeding the vehicle’s maximum capacity
Negligence, including leaving the vehicle unlocked or unattended with the keys inside
Tire, windshield, or interior damage: These are not covered under any protection plan or damage waiver and remain the Renter’s full financial responsibility.
b.
Subsequent Damage: If damage occurs after the rental period due to the Renter’s failure to return the vehicle properly (e.g., leaving the car in an unsafe location), the Renter may still be held liable for that damage.
Telematics Data and Investigations
a.
Use of Telematics Data: In the event of an incident involving damage, theft, or loss, Veygo reserves the right to use data from the vehicle’s GPS and telematics systems to investigate the cause of the incident. This data may be used to determine whether the Renter’s actions or negligence contributed to the damage or loss.
b.
Cooperation with Investigations: The Renter agrees to cooperate fully with Veygo and any relevant insurance providers during the investigation of any damage, theft, or loss incident. This includes providing accurate information, photos, video evidence, and responding to inquiries in a timely manner.
8. Emergency Procedures
Breakdowns and Vehicle Retrieval
a.
No Roadside Assistance: Veygo does not currently offer roadside assistance services. However, in the event of a mechanical breakdown that is not caused by misuse or negligence, Veygo will be responsible for towing and retrieving the vehicle. The Renter must contact Veygo immediately to arrange for the vehicle’s towing.
b.
Towing Responsibility: Veygo will arrange and cover the cost of towing the vehicle to an authorized repair facility if the breakdown is due to a mechanical failure. If the breakdown or issue is due to the Renter’s misuse or prohibited activities, the Renter will be responsible for any towing costs.
c.
Replacement Vehicle: If the vehicle cannot be repaired in a reasonable amount of time and the breakdown is not the Renter’s fault, Veygo will provide a replacement vehicle, subject to availability. If a replacement vehicle is not available, Veygo will issue a prorated refund for the unused portion of the rental period. If the breakdown is caused by the Renter’s actions, Veygo is not obligated to provide a replacement vehicle
.
Emergency Situations
a.
Accidents: In the event of an accident, the Renter must:
Ensure their safety and the safety of others.
Contact local law enforcement to file a police report if required by law.
Notify Veygo immediately through the provided contact details.
Cooperate fully with law enforcement, insurance companies, and Veygo in investigating the incident.
b.
Renter's Responsibility in Emergency Situations: In any emergency situation, including accidents or breakdowns, the Renter is required to notify Veygo immediately. Failure to do so may result in the Renter being held responsible for additional damage or costs incurred due to delayed reporting.
c.
Tire, Windshield, and Interior Damages: As outlined in the Damage, Theft, and Loss section, the protection plan does not cover tire, windshield, or interior damages. In the case of a flat tire or windshield damage, the Renter is responsible for the full repair or replacement cost.
Unauthorized Repairs
a.
No Self-Repairs: Renters are not authorized to perform any repairs on the vehicle, even minor fixes. All repairs must be handled by authorized service centers arranged by Veygo. Any unauthorized repairs or modifications to the vehicle will void any protection plan coverage and may result in additional charges to the Renter.
b.
Towing for Unauthorized Repairs: If the Renter attempts to perform unauthorized repairs or has the vehicle towed to an unauthorized location for repair, Veygo will not cover the costs of the repair or the towing fees. The Renter will be held liable for any damage or additional costs that arise from unauthorized repairs.
Telematics and Emergency Procedures
a.
Use of Telematics: Veygo may use data from the vehicle’s GPS or telematics systems to locate the vehicle in emergency situations. This includes breakdowns, accidents, or theft. By renting a vehicle from Veygo, the Renter consents to the use of telematics data for safety and recovery purposes.
b.
Tracking in Emergencies: In the event of theft, Veygo will use telematics data to assist law enforcement in recovering the vehicle. Renters should not attempt to disable or remove any tracking devices. Any tampering with vehicle tracking systems may result in penalties and legal action.
9. Dispute Resolution, No Lawsuits, and Governing Law
Mandatory Arbitration and Waiver of Right to Sue
a.
Agreement to Arbitrate: By using Veygo’s services, the Renter agrees that any and all disputes, claims, or controversies arising out of or relating to this Agreement, the rental of a vehicle, or any aspect of the relationship between the Renter and Veygo, shall be resolved exclusively through binding arbitration, rather than in court. This includes any claims based on contract, tort, statute, fraud, misrepresentation, or any other legal theory.
b.
No Right to Sue in Court: By entering into this Agreement, the Renter waives their right to file a lawsuit against Veygo in any court of law. All disputes must be resolved through binding arbitration as outlined in this section, and the Renter gives up their right to trial by jury in any legal proceeding.
c.
Class Action Waiver: The Renter further agrees to waive the right to participate in any class action, collective action, or other representative legal proceedings against Veygo. Any dispute resolution proceedings will be conducted only on an individual basis, and neither party may join or consolidate claims with those of any other persons.
d.
Exceptions to Arbitration: The only exception to mandatory arbitration is that both parties retain the right to seek individual claims in small claims court for disputes or claims that fall within the small claims court’s jurisdiction. However, claims may not be pursued on a class or representative basis.
Arbitration Process
a.
Arbitration Rules: Arbitration will be conducted under the rules of the American Arbitration Association (AAA) and will take place in West Lafayette, Indiana, unless otherwise agreed by the parties. The AAA’s rules and procedures can be found on their website (
www.adr.org) and will govern the arbitration proceedings, except as otherwise provided in this Agreement.
b.
Arbitrator’s Authority: The arbitrator will have exclusive authority to resolve any dispute relating to the interpretation, enforceability, or applicability of this arbitration agreement, including any claim that all or part of this agreement is void or voidable. The arbitrator may award relief only on an individual basis, consistent with the limitations set forth in this Agreement.
c.
Costs of Arbitration: Each party will bear its own arbitration costs and legal fees, except as required by law or unless the arbitrator determines that the claim is frivolous. In that case, the Renter may be responsible for reimbursing Veygo’s arbitration costs, including reasonable attorney’s fees.
d.
Final and Binding Decision: The arbitrator’s decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
Limitations of Claims and Liability
a.
Limitation of Liability: To the fullest extent permitted by law, Veygo will not be liable for any indirect, consequential, incidental, punitive, or special damages, including but not limited to lost profits, even if advised of the possibility of such damages. Veygo’s liability in any matter arising from or related to this Agreement, the rental, or use of the vehicle will be limited to the amount paid by the Renter for the rental.
b.
Indemnification: The Renter agrees to indemnify, defend, and hold Veygo, its affiliates, officers, employees, and agents harmless from and against any claims, damages, liabilities, losses, and expenses (including attorney’s fees and costs) arising out of or related to:
The Renter’s use of the vehicle.
Any violation of this Agreement or applicable laws.
Any negligence or misconduct by the Renter or any Authorized Driver.
c.
Time to File a Claim: Any claim or cause of action arising out of or related to this Agreement, the use of Veygo’s services, or the rental of a vehicle must be filed within one (1) year after the cause of action arises. Failure to file within this time frame will result in the claim being permanently barred.
Governing Law and Venue
a.
Applicable Law: This Agreement and all matters arising from it, including disputes, will be governed by and construed in accordance with the laws of the state of Indiana, without regard to conflict of law principles.
b.
Exclusive Venue: Any arbitration under this Agreement shall be conducted in West Lafayette, Indiana. In the event that arbitration is not available or enforceable, any legal action arising from this Agreement shall be filed in the state or federal courts located in West Lafayette, Indiana. Both parties agree to submit to the personal jurisdiction of these courts for any legal proceedings that are not resolved through arbitration.
No Jury Trial and Waiver of Certain Damages
a.
No Jury Trial: The Renter understands and agrees that by entering into this Agreement, they are waiving the right to a jury trial for any claims or disputes against Veygo. All disputes must be resolved through binding arbitration.
b.
Waiver of Certain Damages: The Renter agrees to waive the right to seek or recover any indirect, incidental, punitive, or consequential damages in any dispute or claim against Veygo. This waiver applies regardless of the legal theory or basis of the claim.
10. Miscellaneous Provisions
Assignment
a.
No Assignment by Renter: The Renter may not assign or transfer their rights or obligations under this Agreement to any other party without Veygo’s prior written consent. Any attempted assignment without Veygo’s consent will be null and void.
b.
Assignment by Veygo: Veygo reserves the right to assign or transfer its rights and obligations under this Agreement to any affiliate or successor in interest without restriction.
Severability
a.
Severability of Provisions: If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions of this Agreement will remain in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the extent necessary to make it enforceable, while preserving its intent.
Waivers
a.
No Waiver of Rights: Veygo’s failure to enforce any provision of this Agreement shall not be deemed a waiver of its right to enforce that or any other provision in the future. Similarly, Veygo’s acceptance of any payment or performance from the Renter will not be construed as a waiver of any rights or provisions under this Agreement.
Force Majeure
a.
Force Majeure: Veygo will not be liable for any failure to perform or delay in performance of any of its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, natural disasters, pandemics, and government orders or restrictions. In such cases, Veygo’s obligations under this Agreement will be suspended for the duration of the event causing the failure or delay.
Notices
a.
Delivery of Notices: Any notices required under this Agreement must be sent in writing to the contact information provided by each party. Notices to Veygo should be sent to the email or physical address listed on the Veygo website. Notices will be deemed received when delivered in person, by certified mail, or by email with confirmation of receipt.
Relationship of the Parties
a.
Independent Contractors: This Agreement does not create any joint venture, partnership, employment, or agency relationship between the Renter and Veygo. Both parties are acting as independent contractors, and neither party has the authority to bind or represent the other.
Electronic Communications and Transactions
a.
Consent to Electronic Communications: By using Veygo’s services, the Renter consents to receive all communications electronically, including agreements, notices, disclosures, and other relevant information. Veygo will communicate via the email address provided by the Renter. The Renter agrees that all electronic communications satisfy any legal requirement that such communications be in writing.
b.
Electronic Signatures: The Renter agrees that by accepting these terms electronically, they are providing an electronic signature that has the same legal effect as a handwritten signature. The Renter agrees to be bound by these terms and any other agreements or notices delivered electronically.
Modifications to the Agreement
a.
Changes by Veygo: Veygo reserves the right to modify or update these Terms and Conditions at any time. Any modifications will be effective upon posting to Veygo’s website or other communication to the Renter. The Renter’s continued use of Veygo’s services following any changes constitutes their acceptance of the modified terms.
b.
Notification of Changes: Veygo will provide reasonable notice of any significant changes to this Agreement, either by email or by posting a notice on the website. It is the Renter’s responsibility to review these terms periodically to stay informed of any changes.
Headings
a.
Headings for Convenience: The section headings in this Agreement are for convenience only and do not affect the interpretation of the provisions.
11. Entire Agreement
This Agreement, along with any Rental Agreements, the Privacy Policy, and any other terms or agreements incorporated by reference, constitutes the entire agreement between the Renter and Veygo concerning the rental of vehicles and the use of Veygo’s services. It supersedes any prior agreements, understandings, or representations, whether written or oral, between the parties.
No verbal or written statements that are not expressly included in this Agreement shall be binding upon either party. Any modifications to this Agreement must be made in writing and signed by both parties, except as provided in the “Modifications to the Agreement” section.
